Terms & Conditions — SellTheNews
Version 21. Acceptance of these Terms
These Terms & Conditions (the "Terms") are a public offer (публічна оферта) within the meaning of Articles 633 and 641–642 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce". They are addressed to any person who wishes to use SellTheNews (the "Service").
By starting the bot, pressing the consent button, subscribing, or otherwise using the Service, you accept these Terms in full and without reservation. That acceptance forms a binding contract between you ("you", the "User") and the Provider named above ("we", "us", "SellTheNews"). If you do not agree with any part of these Terms, do not use the Service.
Acceptance is recorded electronically. We store the version number of the Terms you accepted and the moment of acceptance, so that both parties can establish which version governs the relationship at any given time. The version and effective date shown at the top of this document identify the currently published version.
If you accept these Terms on behalf of a legal entity, you represent that you are authorised to bind that entity.
2. What the Service is — and what it is not
SellTheNews collects publicly available financial and crypto news, processes it using automated and AI-based analysis, and delivers the resulting output — which we call "signals" — to subscribers through Telegram. Optionally, and only if you choose to set it up, the Service can place orders on a cryptocurrency exchange account that belongs to you (see §5).
The Service is informational and educational only.
- Signals are not investment advice, financial advice, legal advice, tax advice, or a personal recommendation. They are not tailored to your financial situation, investment objectives, risk tolerance, experience, or needs. We do not know your circumstances and we do not assess their suitability for you.
- Signals are not a solicitation or an offer to buy or sell any financial instrument, security, cryptoasset, or derivative.
- Nothing in the Service is a guarantee of any result. We make no promise, warranty, or representation about profit, return, accuracy, win rate, drawdown, or any other outcome. Any figure, statistic, backtest, illustration, or example we publish is historical or hypothetical. Past performance is not indicative of future results. Hypothetical and backtested results have inherent limitations and do not reflect real trading conditions such as slippage, liquidity, fees, or funding costs.
- Signals are generated by automated systems and large language models. They can be wrong. AI systems can misread a news item, act on stale, incomplete, duplicated or fabricated information, produce factually incorrect statements ("hallucinate"), or reach conclusions that a human analyst would not. The Service may also fail to send a signal, send it late, or send it with an error. You must not treat any signal as verified fact.
- Trading cryptoassets and other leveraged instruments is high-risk. Prices are volatile. You can lose some or all of the funds you commit, and with leveraged or margin products you can lose more than your initial deposit. Only commit funds you can afford to lose entirely.
You are solely responsible for every trading and investment decision you make. You should do your own research and, before acting, consider obtaining advice from a qualified, appropriately licensed financial professional in your own jurisdiction.
3. We are not a licensed adviser, broker, or fund manager
SellTheNews is a software and information service. We are not:
- a registered investment adviser or investment firm in any jurisdiction;
- a broker, dealer, or broker-dealer;
- a Commodity Trading Advisor (CTA), Commodity Pool Operator (CPO), or futures commission merchant;
- a licensed asset manager, portfolio manager, or fund;
- a custodian, bank, payment institution, or virtual asset service provider (VASP) holding client assets;
- an exchange, or an agent or representative of any exchange.
We do not manage your money, we do not hold your money, and we do not exercise discretionary authority over your account. We do not provide individualised advisory services, and we do not hold ourselves out to the public as providing them. Where the Service places an order, it does so mechanically, on your own account, under the configuration you yourself set (see §5).
Nothing in the Service creates a fiduciary, advisory, agency, partnership, or trust relationship between you and us.
4. Eligibility and restricted jurisdictions
4.1 Who may use the Service
By using the Service you represent and warrant that:
- you are at least 18 years old;
- you have full legal capacity to enter into a binding contract under the law applicable to you;
- you are acting for yourself and not on behalf of an undisclosed third party;
- you understand the risks described in §2 and can bear a total loss of any funds you trade;
- your use of the Service does not breach any law, regulation, or rule that applies to you, including financial-services, securities, tax, exchange-control, and sanctions law.
4.2 Restricted jurisdictions and persons
The Service is not offered to, and may not be used by:
- US persons — including any natural person resident in the United States of America, any entity organised or incorporated in the United States, and any person accessing the Service from the United States or its territories;
- persons who are resident in, located in, a citizen of, or organised under the laws of a comprehensively sanctioned jurisdiction: North Korea (DPRK), Iran, Cuba, and Syria;
- persons who are resident in or located in the Russian-occupied territories of Ukraine, including Crimea, Donetsk, and Luhansk;
- persons who are subject to, or owned or controlled by a person subject to, targeted sanctions imposed by Ukraine, the United States (including OFAC's SDN list), the European Union, the United Kingdom, or the United Nations;
- persons whom the exchange you intend to connect (for example Bybit) itself restricts under its own service-restricted-countries policy. If your exchange would not onboard you, we will not onboard you either.
By using the Service you represent and warrant, on a continuing basis, that you are not a restricted person and are not located in a restricted jurisdiction, and that you will notify us immediately and stop using the Service if that changes.
Important — this is a contractual restriction, not a technical block. We do not currently operate IP-based geo-blocking or identity verification, and the Service may be technically reachable from a restricted jurisdiction. The fact that you were able to start the bot, subscribe, or receive signals is not a confirmation that you are eligible, and it does not waive this section. Responsibility for complying with §4 is yours. We may terminate your access and refuse or reverse payments at any time if we believe §4 is breached (see §9).
5. Connecting your exchange account (API keys and automated orders)
5.1 Your account, your key
The Service can optionally connect to a cryptocurrency exchange account — today Bybit, on testnet, with mainnet support planned. That account is yours. The connection is made using an API key that you create in your own exchange account and provide to us voluntarily.
- We do not open, operate, or control any exchange account on your behalf.
- We are not a custodian. We never hold, receive, take title to, pool, or have withdrawal access to your funds or cryptoassets. Your assets remain at all times in your own account with your own exchange, governed by your agreement with that exchange.
- You should create the API key with the narrowest permissions necessary (trading only) and you must not grant withdrawal or transfer permissions. If you grant a permission the Service does not need, you do so at your own risk.
- We recommend you bind the key to our server IP address where your exchange supports IP whitelisting, and that you rotate your key periodically.
5.2 Your authorisation
By connecting an API key and enabling automated execution, you instruct and authorise us to submit orders and related trading instructions to your exchange account, automatically and without seeking confirmation from you for each individual order, in accordance with the settings you have configured. You may withdraw that authorisation at any time by disabling automated execution in the bot, or immediately and unilaterally by deleting or disabling the API key in your exchange account.
5.3 Your responsibility
You acknowledge and agree that:
- you are solely responsible for the security of your API key and your exchange account — including key creation, permission scope, storage, rotation, revocation, and your exchange's own security features such as two-factor authentication;
- every order placed using your connected key is your order, is treated by your exchange as authorised by you, and is your responsibility and risk — whether it was triggered by a signal, by a configuration you set, by a bug, by an error in our system, or by a third party who obtained access to your key;
- this mirrors the position your exchange takes. Bybit's own API Terms place liability for the acts of third-party software and API clients on the account holder. We do not, and cannot, assume a liability that our own supplier places on you;
- you must monitor your own account. Automated execution does not remove your obligation to supervise your positions, margin, and exposure. You should set your own risk limits (position size, leverage, stop-losses) at the exchange level and not rely solely on the Service;
- technical failures happen. Exchange downtime, API rate limits, network faults, latency, maintenance, exchange-side rejection, partial fills, slippage, and our own outages can all mean that an order is placed late, placed at a different price, placed twice, or not placed at all — including an order that would have closed a losing position. We do not guarantee that any instruction will reach your exchange or be executed;
- testnet is not mainnet. Results, fills, liquidity, and behaviour on a test environment do not predict real-money behaviour.
5.4 Indemnity
You agree to indemnify and hold us harmless against any claim, loss, liability, cost, or expense (including reasonable legal fees) arising out of or in connection with your exchange account, your API key, your trading activity, or your breach of §4 or §5.
6. Subscription, billing, trial, and refunds
6.1 Plans and trial
Access to signals and automated execution is provided on a paid subscription basis, offered in three billing periods (1 month, 3 months, 1 year). The prices and billing periods currently in effect are always the ones shown to you in the bot and at https://try.sellthenews.online at the moment you subscribe — we do not restate a fixed figure here because it would go stale the first time we change a price, and the price you are actually charged is always the one quoted to you live, never a number in this document. New users also get a free trial period of 7 days. We may change prices, plans, and trial terms for future billing periods; we will not change the price of a period you have already paid for.
6.2 Payment
Payments are processed by Monobank (АТ «Універсал Банк») as our payment provider. We do not receive or store your full card number, CVV, or card expiry date — those are handled by the payment provider under its own terms and its own PCI-DSS obligations. We store only the billing record (amount, currency, date, status, and the provider's transaction identifier).
6.3 Currency and settlement — please read
Our payment provider settles in Ukrainian hryvnia (UAH), regardless of the currency in which a price is quoted to you. This has practical consequences you should expect:
- if a price is quoted in a currency other than UAH (for example USD or EUR), the amount actually charged is converted and settled in UAH;
- the amount and currency shown on your card statement may differ from the quoted price, because your card issuer applies its own exchange rate and may add a foreign-currency or cross-border fee;
- exchange-rate movement between the moment you see the price and the moment your bank posts the transaction can change the final amount;
- we do not control, set, or receive your bank's exchange rate or fees, and we cannot refund a difference caused by them.
By subscribing you accept that the UAH-settled amount is the amount charged and that currency-conversion differences and issuer fees are not a ground for a refund or chargeback.
6.4 Renewal and cancellation
Unless stated otherwise for your plan, subscriptions renew automatically at the end of each billing period at the then-current price for that plan, until you cancel. You may cancel at any time through the bot or by writing to ops@sellthenews.online. Cancellation takes effect at the end of the current paid period — you keep access until then, and you are not charged again afterwards. Cancelling the subscription does not by itself delete your API key or your data; to do that, see the Privacy Policy below.
6.5 Refunds
- Trial: if a trial is offered, you can cancel during the trial at no charge. That is the intended way to evaluate the Service.
- Consumer withdrawal right: where Ukrainian consumer-protection law or the mandatory consumer law of your own country of residence grants you a right to withdraw from a distance contract, that right applies and nothing in these Terms limits it. Where such a right applies, you may request a refund within 14 calendar days of a charge — the statutory withdrawal period under Ukrainian consumer-protection and e-commerce law for a distance contract, applicable where the digital service has not yet begun being delivered to you with your prior express consent and acknowledgment of loss of this right.
- Otherwise, because the Service is a digital service delivered immediately and continuously, fees already paid for a started billing period are non-refundable, except where we are required by law to refund them, or where we have failed to provide the Service for a sustained period through our own fault — in which case we will normally issue a pro-rata credit or refund for the affected days.
- Trading losses are never a ground for a refund. A signal that did not work out, or a trade that lost money, is not a service failure (see §2 and §7).
- Refund requests go to ops@sellthenews.online and should include your Telegram username or ID and the transaction date.
6.6 Failed payments and chargebacks
If a payment fails, we may suspend your access until payment succeeds. If you initiate a chargeback or payment dispute instead of contacting us first, we may suspend or terminate your access immediately (see §9) and may decline to serve you in future. Please write to ops@sellthenews.online first — most billing issues are resolved faster that way.
7. Limitation of liability
Please read this section carefully — it limits what you can recover from us.
7.1 Provided "as is"
The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law, we exclude all warranties, conditions, and representations not expressly stated in these Terms — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, or uninterrupted availability. We do not warrant that the Service will be error-free, that signals will be accurate or profitable, or that defects will be corrected.
7.2 No liability for trading outcomes
We are not liable for any trading or investment loss. This includes, without limitation, losses arising from: acting or not acting on a signal; a signal that was wrong, late, missing, duplicated, or based on inaccurate or fabricated news; AI or model error, bias, or hallucination; an order placed, mispriced, partially filled, or not placed through the connected API; liquidation, margin call, funding cost, slippage, or fees; your own configuration, position sizing, or leverage choices; and exchange, custodian, stablecoin, or counterparty failure.
7.3 Excluded damages
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost opportunity, lost or "would-have-been" gains, lost data, business interruption, or reputational harm — whether or not foreseeable and whether the claim is in contract, delict/tort, statute, or otherwise.
7.4 Service interruption
We are not liable for interruption, suspension, degradation, delay, or discontinuation of the Service, whether planned or not, including where caused by: maintenance or deployment; failure or policy change of Telegram, Bybit, Monobank, an AI/model provider, a news source, or a hosting or network provider; rate limiting or API changes by a third party; cyber-attack; or force majeure, including armed conflict, hostilities, air-raid alerts, mobilisation, martial law, and disruption of power or communications in Ukraine. Where such an event prevents us from performing, our obligations are suspended for its duration.
7.5 Cap
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims arising out of or relating to the Service is limited to the total amount of subscription fees you actually paid us in the three (3) months immediately preceding the event giving rise to the claim, or UAH 1,000, whichever is greater.
7.6 What is not excluded
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for wilful misconduct, or under mandatory Ukrainian consumer-protection provisions. If you are a consumer, your statutory rights are unaffected.
8. Intellectual property
8.1 Ours
The Service and everything in it — the bot, the website, the software, the models and prompts, the analysis pipeline, the signal format and methodology, the text, graphics, and the names "SellTheNews" and "@SellTheNewsAIBot" and associated logos — are owned by us or licensed to us, and are protected by copyright, trade-mark, and other intellectual-property law.
8.2 Your licence
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to receive and use the signals and other Service content for your own personal, non-commercial trading and information purposes, for as long as your subscription is active and you comply with these Terms.
8.3 What you may not do
You may not:
- redistribute, republish, resell, relay, forward in bulk, mirror, or syndicate signals or Service content to any third party, whether free or paid — including by copying signals into another Telegram channel, group, Discord server, chat, feed, newsletter, social-media account, website, or API;
- operate a copy-trading, signal-reselling, white-label, or derivative signal service based on our output;
- share, resell, or provide access to your account, or allow more than one person to use a single subscription;
- scrape, harvest, or programmatically extract Service content, or circumvent rate limits, paywalls, or access controls;
- reverse-engineer, decompile, or attempt to derive our models, prompts, methodology, or source code, except to the extent such restriction is prohibited by law;
- use the Service or its output to train, fine-tune, or evaluate a machine-learning model;
- use our name, marks, or content in a way that suggests endorsement, partnership, or that you are us.
8.4 Third-party content
News headlines, quotes, market data, and other third-party material surfaced by the Service remain the property of their respective owners and are shown for identification, commentary, and analysis. We do not claim ownership of them, and we are not responsible for their accuracy.
8.5 Feedback
If you send us suggestions, bug reports, or feedback, you grant us a perpetual, worldwide, royalty-free right to use them without obligation or compensation to you.
9. Suspension and termination
9.1 By you
You may stop using the Service at any time: cancel your subscription (§6.4), revoke your API key in your exchange account, and block or delete the bot in Telegram. To have your data deleted, see the Privacy Policy below.
9.2 By us
We may suspend or terminate your access immediately, with or without prior notice, if:
- you breach these Terms, including §4 (eligibility and restricted jurisdictions), §5 (exchange connection), or §8 (intellectual property);
- we determine or reasonably suspect that you are a restricted person or are located in a restricted jurisdiction, or that serving you would breach sanctions or other applicable law;
- we detect or reasonably suspect fraud, payment fraud, stolen or unauthorised payment instruments, money laundering, use of a stolen API key, or use of the Service to trade on someone else's account without authority;
- you initiate a chargeback or payment dispute without first contacting us (§6.6), or your payment fails and remains unpaid;
- you abuse, threaten, or harass us, our staff, or other users, or you attack, overload, probe, or attempt to disrupt the Service;
- you redistribute or resell signals (§8.3);
- we are required to do so by law, by a court or authority, or by Telegram, Bybit, Monobank, or another provider we depend on.
9.3 Effect of termination
On termination: your licence under §8.2 ends immediately; automated execution stops and we cease submitting orders on your account; and we delete or disable your stored API key. Terminating the Service does not close your exchange positions. Any open position on your exchange account remains yours — you must manage or close it yourself, directly with your exchange. We strongly recommend you also revoke the API key on the exchange side.
Where we terminate for a breach under §9.2, we may retain fees paid for the current period. Where we terminate without cause, we will refund the unused portion of the current period pro rata. Sections 2, 3, 5.3, 5.4, 7, 8, 10 and 12 survive termination.
9.4 Discontinuing the Service
We may discontinue the Service, or any feature of it, in whole or in part. Where we discontinue the Service entirely we will give reasonable advance notice through the bot and refund the unused portion of any prepaid period.
10. Governing law and dispute resolution
10.1 Governing law
These Terms, and any relationship or dispute arising out of or in connection with them or with your use of the Service, are governed by and construed in accordance with the law of Ukraine, without regard to conflict-of-laws rules. Where you are a consumer resident in another country, this does not deprive you of the protection of the mandatory consumer-protection rules of your country of habitual residence.
10.2 Talk to us first
Before starting any formal proceeding, please contact us at ops@sellthenews.online with a description of the issue and what you would like us to do. We will try in good faith to resolve it, and we ask that you allow us 30 days to respond substantively. Most disputes are resolved at this stage.
10.3 Courts
If we cannot resolve the matter, any dispute is subject to the jurisdiction of the competent courts of Ukraine, at the place of registration of the Provider — ФОП Кондратюк Даніл Вадимович (РНОКПП 3641311372), запис в ЄДР № 2010350000000556295 від 07.05.2024; місцезнаходження: Україна, 49098, Дніпропетровська обл., м. Дніпро, вул. Сонячна Набережна, буд. 14, кв. 8 — in accordance with Ukrainian procedural law. A consumer may also bring proceedings in the courts of their own place of residence where mandatory law so provides.
10.4 Individual claims
To the extent permitted by applicable law, disputes are resolved on an individual basis. You agree not to bring a claim as a plaintiff or class member in any class, collective, or representative proceeding.
10.5 Language
This document is currently published in English only. If and when an official Ukrainian translation is published alongside it, both versions are intended to have the same meaning, and the Ukrainian version will prevail for the purposes of Ukrainian law in the event of a discrepancy. Until a Ukrainian version exists, this English version is the sole governing text.
10.6 Severability and waiver
If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it.
10.7 Entire agreement and assignment
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any earlier statement, disclaimer, or marketing material. You may not assign your rights under these Terms. We may assign them to a successor of our business, including on incorporation of the business into a legal entity, on notice to you.
11. Changes to these Terms
11.1 Versioning
These Terms are versioned. Each published version carries a Version number and an Effective date at the top of this document, and the version you accepted is recorded against your account. We keep prior versions available on request at ops@sellthenews.online.
11.2 Non-material changes
We may make non-material changes — typo fixes, clarifications, reformatting, updated contact details, or changes required to describe a feature accurately — by publishing an updated version. Such changes take effect on their Effective date, and continued use of the Service after that date constitutes acceptance.
11.3 Material changes and re-consent
For material changes — for example a change to the restricted-jurisdictions list, to the exchange-connection and API-key terms, to the limitation of liability, to billing or refund terms, or to governing law — we will:
- publish a new version with an incremented Version number and a new Effective date;
- notify you through the bot (and, where we have it, by another channel) at least 14 days before the new version takes effect, unless a shorter period is required by law, by a regulator, or to address a security or sanctions issue;
- ask you to accept the new version explicitly before you continue to use the Service.
If you do not accept a material change, you may cancel your subscription before the new version takes effect and we will refund the unused portion of your current prepaid period pro rata. We will not continue to serve you under a version you have not accepted, and we may suspend access until you accept or cancel.
11.4 Price changes
Changes to subscription prices apply only to billing periods beginning after we notify you, and we will give at least 14 days' notice. You may cancel before the new price takes effect.
12. Contact and notices
Notices from us to you may be sent through the bot (a Telegram message to the chat you use with the Service) or to any email address you have given us, and are deemed received when sent. Notices from you to us must be sent to ops@sellthenews.online and are deemed received on the next business day in Ukraine. We aim to respond to enquiries within 5 business days, and to data-subject requests within the periods set out in the Privacy Policy.
Privacy Policy — SellTheNews
Version 2This Privacy Policy explains what personal data SellTheNews collects when you use the Telegram bot @SellTheNewsAIBot or the website https://try.sellthenews.online, why we collect it, who we share it with, how long we keep it, how we protect it, and what rights you have.
We are the data controller for the data described here. It is written to be understandable to a non-lawyer; where it uses GDPR terms it is because they carry specific legal meaning. It forms part of, and should be read together with, our Terms & Conditions above.
1. What we collect
We try to collect as little as possible. We do not ask for your real name, home address, date of birth, passport or ID document, or a selfie, and we do not run identity verification.
From Telegram, when you start the bot:
| Data | Why it exists |
|---|---|
| Your Telegram user ID (a number) | This is your account identifier with us. Everything else is linked to it. |
| Your Telegram username, first/last name as set in your profile, if you have them | Shown in support conversations so we can find your account |
| Your language / locale setting | So we send messages in a language you read |
| The chat ID of your conversation with the bot | So we know where to deliver signals and notices |
What you configure in the bot:
- the trading pairs, assets, and markets you track, and your notification, filtering, and signal preferences;
- your automated-execution settings (whether it is on, and the parameters you set);
- which version of the Terms & Conditions you accepted, and when — we are required to be able to prove this, and it is how §11 of the Terms works.
If you choose to connect an exchange (optional):
- your exchange API key and API secret for the account you connect (today Bybit), stored encrypted (see §6);
- the environment (testnet or mainnet) and the permissions scope of the key;
- records of the orders and instructions we submitted on your behalf, and the exchange's responses — needed so that you and we can reconstruct what happened, and so we can investigate errors and disputes.
If you subscribe (payments):
- billing records: plan, amount, currency, quoted and settled amounts, date and time, status (paid, failed, refunded, chargeback), the payment provider's transaction identifier, and the invoice/receipt;
- subscription state: start date, renewal date, trial status, cancellation date.
We do not collect or store your full card number, CVV, or card expiry date. Those go directly to Monobank, our payment provider, and we never see them. Depending on what the provider returns, we may see a masked card fragment (for example the last four digits) and the card brand, which we keep only to help you identify a payment.
Technical and operational data:
- server logs of interactions with the bot and the API — timestamps, the command or action, your Telegram ID, request and response status, error messages and stack traces, and, for web requests to the website, IP address and user-agent;
- aggregate usage counts (for example how many signals were delivered), used to monitor and improve the Service.
Message content: we process the messages and commands you send the bot in order to respond to them. We do not read your private conversations elsewhere in Telegram — the bot only receives what is sent to it.
What we deliberately do not collect: special-category data (health, religion, biometrics, political opinions, and the like). Please do not send it to us. We also do not knowingly collect data from anyone under 18; the Service is 18+ (see §4 of the Terms). If you believe a minor has used the Service, write to ops@sellthenews.online and we will delete the account.
2. Why we collect it, and our lawful basis
We only process personal data where we have a lawful basis to do so. Under the GDPR (and the equivalent provisions of Ukraine's Law "On Personal Data Protection"), our bases are:
| What we do | Why | Lawful basis (GDPR Art. 6) |
|---|---|---|
| Create and run your account; deliver signals to your chat; apply your preferences | This is the Service you asked for | Contract — Art. 6(1)(b), necessary to perform our contract with you |
| Store and use your exchange API key to place the orders you configured | You cannot have automated execution without it | Contract — Art. 6(1)(b); the key is provided and the authorisation given by you, and you can withdraw it at any time |
| Process payments, renewals, refunds; keep billing records | To charge you and to give you receipts | Contract — Art. 6(1)(b); and legal obligation — Art. 6(1)(c), for tax and accounting records |
| Record which Terms version you accepted, and when | To establish the contract and prove consent | Contract — Art. 6(1)(b); legitimate interests — Art. 6(1)(f) |
| Keep server logs; monitor errors; investigate incidents; keep the Service secure and prevent abuse, fraud, and chargeback abuse | To keep the Service working and safe | Legitimate interests — Art. 6(1)(f), in the security, integrity, and continuity of our service; balanced against your rights, and limited to what is necessary |
| Respond to your support messages | To help you | Contract — Art. 6(1)(b); legitimate interests — Art. 6(1)(f) |
| Aggregate, non-identifying usage statistics to improve signals and the product | To make the Service better | Legitimate interests — Art. 6(1)(f) |
| Comply with tax, accounting, sanctions-screening, and lawful requests from authorities | Because we must | Legal obligation — Art. 6(1)(c) |
| Send you optional marketing messages, if you opt in | Only if you asked for them | Consent — Art. 6(1)(a); withdraw any time, no effect on the Service |
We do not sell your personal data. We do not share it with advertisers, data brokers, or ad networks. We do not use it for advertising profiling.
No automated decisions about you. The Service uses AI to analyse news and generate signals — that is analysis of public market information, not of you. We do not use automated decision-making or profiling that produces legal effects for you or similarly significantly affects you within the meaning of GDPR Art. 22. Your trading decisions remain yours, and orders placed via your API key follow settings you chose.
3. Who we share data with
We share personal data only with the parties below, only to the extent necessary, and only under a contract or their own published terms.
Platform and infrastructure
- Telegram (Telegram Messenger Inc. / Telegram FZ-LLC) — the platform the bot runs on. Every message between you and the bot passes through Telegram, and Telegram already holds your account data independently of us. Telegram processes it as its own controller, under its own privacy policy (https://telegram.org/privacy), which we do not control. If you are not comfortable with that, do not use a Telegram-based service.
- Hosting and infrastructure provider — Contabo (VPS hosting) — runs our servers, application, and database, and therefore stores the data described in §1 on our instructions, as our processor.
- No third-party analytics or logging provider. We do not use a separate error-monitoring, log-aggregation, or analytics service. Logs remain on our own infrastructure, on the same server named above.
- AI / model providers — we send news text and market data to AI providers to generate the analysis. We do not send your personal data, your Telegram ID, your API keys, your positions, or your account balances to any AI provider for this purpose.
Only if you choose to connect an exchange
- Bybit — when you enable execution, we transmit trading instructions to Bybit authenticated with your API key. Bybit receives the order data and acts on your account. Bybit is a separate, independent controller of your exchange-account data under its own privacy policy and API Terms, and its handling of your data is governed by your relationship with Bybit, not by this Policy. If you never connect an exchange, no data goes to Bybit.
Payments
- Monobank (АТ «Універсал Банк») — processes your card payment as an independent controller for the payment itself, under its own privacy policy and Ukrainian banking and payment-services law. Card details go to Monobank, not to us. Monobank returns to us the transaction result and identifier. Payments settle in UAH (see §6.3 of the Terms).
Professional and legal
- Accountants, tax advisers, and auditors — access to billing records as needed for our tax and accounting obligations as a Ukrainian ФОП.
- Lawyers, and courts or public authorities — where we are legally required to disclose, or need to establish, exercise, or defend legal claims. We disclose only what is necessary and, where we lawfully can, we will tell you.
- A successor — if the business is transferred, incorporated into a legal entity, or reorganised, data may transfer to the successor, which will remain bound by a policy no less protective. We will notify you.
International transfers. We are in Ukraine. Some processors and platforms operate outside Ukraine and the EEA. Ukraine is recognised by the European Commission as providing adequate protection for personal data, and where we transfer data to a country without an adequacy decision we rely on Standard Contractual Clauses or another mechanism permitted by GDPR Chapter V. Telegram, Bybit, and Monobank determine their own transfer arrangements as independent controllers. You can ask us at ops@sellthenews.online which mechanism applies to a specific transfer.
4. How long we keep it
We keep data only as long as we need it.
| Data | Retention |
|---|---|
| Account data (Telegram ID, locale, preferences, tracked pairs) | While your account is active, then up to 90 days after you delete the account or last use the Service, then deleted or anonymised |
| Exchange API key and secret | Until you disconnect the exchange, revoke automated execution, delete your account, or we terminate access — then deleted promptly, and in any event within 7 days, from live systems and from backups on their normal rotation. Also deleted if a key is invalid or unusable for 90 days |
| Execution records (orders we submitted and exchange responses) | 12 months, to allow investigation of errors and disputes; then deleted or aggregated |
| Terms-acceptance records (version + timestamp) | 3 years after the contract ends — this is the limitation period for contract claims under Ukrainian law |
| Billing and payment records, invoices | Up to 3 years, and longer where Ukrainian tax and accounting law requires it — currently up to 1,095 days / 3 years for tax records, extended where an audit or dispute is open. These records cannot be deleted on request while that obligation runs (see §5) |
| Server and error logs | 90 days rolling, then deleted. Security-incident logs may be kept longer while the incident is investigated |
| Support correspondence | 24 months from the last message |
| Aggregate, anonymised usage statistics | Indefinitely — this is no longer personal data and cannot be traced to you |
| Backups | Encrypted backups are retained on a rolling schedule of up to 30 days, after which deleted data disappears from them too |
Where a legal obligation or an open dispute requires us to keep something longer, we keep only what is necessary for that purpose and nothing more.
5. Your rights, and how to use them
Wherever you are, you can ask us to do the following, and we will do it unless the law requires otherwise:
- Access — get a copy of the personal data we hold about you, and information about how we use it.
- Rectification — have inaccurate or incomplete data corrected. Note that data Telegram supplies (your username, name, locale) is corrected by changing it in Telegram.
- Erasure ("right to be forgotten") — have your data deleted. We will delete your account, preferences, API key, and execution records. We must keep billing and tax records for the statutory period (§4), and we will keep the minimum record needed to show we handled your request.
- Restriction — ask us to pause processing while a dispute about accuracy or lawfulness is resolved.
- Objection — object to processing we base on legitimate interests (§2). We will stop unless we have compelling grounds that override your rights. If you object to marketing, we stop immediately, no questions asked.
- Data portability — receive the data you gave us in a structured, commonly used, machine-readable format (we provide JSON), or have it sent to another controller where technically feasible.
- Withdraw consent — where we rely on consent, withdraw it at any time. This does not affect processing already carried out.
- Withdraw your exchange authorisation — disconnect the exchange in the bot at any time, and revoke or delete the API key in your exchange account. Revoking at the exchange is immediate and does not depend on us.
- Not be subject to automated decision-making — as noted in §2, we do not carry out decision-making of the kind GDPR Art. 22 covers.
These are the rights guaranteed to users in the EU and EEA by GDPR Articles 15–22, and to users in Ukraine by the Law of Ukraine "On Personal Data Protection". We extend the same handling to all users regardless of location, because running two standards would be worse for everyone.
How to exercise them. Email ops@sellthenews.online from the address associated with your account, or message the bot, stating what you want and including your Telegram username or Telegram user ID so we can locate your account. We will respond within 30 days (GDPR Art. 12(3)); if a request is complex we may extend by up to two further months and will tell you why within the first month. There is no charge, unless a request is manifestly unfounded or excessive or repeated, in which case we may charge a reasonable fee or decline, and will explain why.
We may need to confirm that a request really comes from you before we act on it — usually by asking you to confirm from the Telegram account in question. This protects you: we will not hand over or delete an account's data on the word of someone who cannot demonstrate control of it.
Complaints. If you are unhappy with how we handled your data or your request, please tell us first at ops@sellthenews.online. You also have the right to complain to a supervisory authority:
- Ukraine — the Ukrainian Parliament Commissioner for Human Rights (Уповноважений Верховної Ради України з прав людини), www.ombudsman.gov.ua;
- EU/EEA — the data protection authority of your country of residence, place of work, or where the issue occurred;
- UK — the Information Commissioner's Office (ICO).
You may also seek a judicial remedy (see §10 of the Terms).
Our contact point for all privacy matters is ops@sellthenews.online, reaching 8. We are not required to appoint a Data Protection Officer and have not appointed one; privacy requests go to the address above and are handled by the Provider directly.
6. How we protect your data
We take security seriously, and the most sensitive thing we hold is your exchange API key. What we do:
- API keys are stored encrypted. API keys and secrets are encrypted at rest using strong, industry-standard authenticated encryption. Encryption keys are held separately from the database, in the application's secret configuration, and are not stored alongside the data they protect. A key is decrypted in memory only at the moment it is needed to sign a request to your exchange, and it is never written to logs, error reports, or analytics, and never displayed back to you in full.
- Transport encryption. All traffic between the bot, our servers, your exchange, and our payment provider uses TLS.
- No withdrawal permissions. The Service is designed to work with trading-only API keys. We do not request, and will not use, withdrawal or transfer permissions. Even if a key were compromised, a correctly scoped key cannot be used to move your funds off the exchange. Please scope your key accordingly (see §5.1 of the Terms) — this is the single most effective protection available to you.
- No card data. We never receive or store full card numbers, CVVs, or expiry dates.
- Access control. Access to production systems and the database is limited to the Provider and is protected by strong authentication. We apply least privilege and do not grant third parties standing access to personal data.
- Data minimisation. We do not collect identity documents or real-world identity data, so there is very little to lose in the first place.
- Backups are encrypted and retained on a limited rotation (§4).
- Monitoring and patching. We monitor for errors and anomalies and keep dependencies updated.
Honest limits. No system is perfectly secure, and we cannot guarantee absolute security. Security also depends on you: on your Telegram account security (enable two-factor authentication and a cloud password), on your exchange account security, and on how you scope and manage your API key. If your Telegram account is compromised, whoever controls it can control the bot.
Breach notification. If a personal-data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority within 72 hours of becoming aware of it, as GDPR Art. 33 requires, and we will notify you without undue delay where the risk to you is high. If exchange API keys are, or may have been, affected, we will tell you immediately and advise you to revoke your key at once — and we will disable the stored keys ourselves.
If you suspect a problem, revoke your API key at your exchange first, then write to ops@sellthenews.online. Security researchers are welcome to report vulnerabilities to the same address; please give us a reasonable period to fix an issue before disclosing it publicly.
7. Cookies and the website
The bot itself does not use cookies — it runs inside Telegram. The website https://try.sellthenews.online is a static page that sets no cookies at all. It stores two small preferences in your browser's local storage — stn-theme (light/dark) and stn-lang (language) — which never leave your device and are not readable by us. The page loads web fonts from Google Fonts (fonts.googleapis.com, fonts.gstatic.com); loading them discloses your IP address and browser details to Google as the operator of that font service, under Google's own privacy policy, which we do not control. Our server also records standard web-server logs for requests to this site, including IP address and user-agent, retained per §4. We run no analytics or tracking on this site today. If we later add analytics, any non-essential cookie, or a non-essential third-party resource, we will ask for your consent first and update this Policy.
8. Changes to this Policy
This Policy is versioned in the same way as the Terms, with a Version number and Effective date at the top.
We may update it — to describe a new feature, a new processor, or a change in the law. When we do:
- non-material changes (clarifications, corrections, an updated processor name) take effect on publication;
- for material changes — a new purpose for processing, a new category of data, a new category of recipient, a materially longer retention period, or a change of lawful basis — we will notify you through the bot at least 14 days in advance and, where the change requires your consent, ask for it before the change applies to your data. We will not start a materially new use of data you gave us under an earlier version without telling you.
If you do not accept a material change, you may stop using the Service and request deletion of your data (§5). Previous versions are available on request at ops@sellthenews.online.
